Berkeley, Dec. 23 -- In a rare bit of good news for working people this season, clerical workers at the University of California have won improved job security and benefits for "permatemps," misclassified temporary employees.
More than 1,200 workers who might otherwise be facing unemployment will benefit from the union's successful settlement of an unfair labor practice charge against the University.
The Coalition of University Employees will notify members that a moratorium on firing will be extended through next summer. Employees have until February 3 to file a grievance for retroactive reclassification. An independent arbitrator will review individual cases and require the University to re-classify employees correctly.
Because of the union's intervention, many workers will be converted to career status, gaining medical and pension benefits.
In addition, the University has agreed to stop abusing the "temporary" or "floater" classification, and to provide timely, accurate information to the union to prevent further abuses.
The settlement reflects resolution of one of nearly 40 unfair labor charges filed by CUE against the University. UC has settled cases involving harassment of union members and officials, failing to provide information required under law, and interfering with employees' right to collective action.
The Coalition of University Employees represents 18,000 clerical employees, including administrative and library assistants, cashiers, public safety dispatchers, and child care workers at the nine UC campuses, associated medical centers, Office of the President, and Lawrence Berkeley National Lab. Clerical workers struck Berkeley/UCOP, Davis, Riverside, Santa Barbara, and Santa Cruz in August and October 2002 over the University's unfair labor practices.
