Dear Candidates,

Additional Rules and Instructions for Election Candidates

Please read all information below - If you have questions, contact the Election Committee promptly.

CUE Staff & Exclusion from Elections & Internal Affairs

Staff hired by CUE at the Statewide Office, as well as at the Locals, are prohibited from involvement in ANY election for officers of CUE. The LWU (Labor Workers Union is the union for our staff) contract with CUE expressly requires that staff remain neutral:

Article 4: Dignity & Respect/Neutrality of Staff

D. Neutrality of Staff. Consistent with the principle of building and neutrality in the internal partisan affairs and debates of CUE (including but not limited to, CUE internal elections). Elections, in this case, mean internal membership votes on elected positions. No member of the LWU Bargaining Unit shall be compelled or permitted, in any way, to participate in a partisan way in any internal elections, including on her/his own time. Nor shall any member of CUE impose or threaten to impose retaliatory action against staff for refusing to engage in election activities of a partisan nature.

The Election Committee will notify the CUE-LWU Management Group and the Statewide Executive Board should we become aware of any violations or possible violations of this article. The violation of this article can result in disciplinary action taken against the Staff member and possible election challenges by members.

Instructions for Rebuttals

Each candidate will be given access to the statement(s) of their opponent(s) on Sept. 1, 2006. Assuming that all candidates have access to the Statewide web site, we will post the statements of all candidates on a web page and provide you with the url. Any candidate who does not have computer access, should request that we provide the statements via e-mail or fax. Please contact the Election Committee immediately if you will need an e-mail or fax - please include the address or fax number and an appropriate subject line.

You may write a rebuttal(s) to your opponent(s) statement(s). Please limit your rebuttal to a maximum of 250 words. Be aware that ballot packets include all statements, balloting instructions and two additional envelopes. Election materials are expensive to print and to mail. Please keep this in mind as you prepare your materials.

Instructions for Campaign Expenditures

Should you choose to spend money to campaign, you must keep all receipts to turn in at the end of the Election. Please provide the following information to the Election Committee no later than October 14, 2006 (the day of the ballot count):

All receipts for expenditures for your campaign, identify what each expense was for, and a total of all expenditures. In addition, if money was spent by others on your behalf, their receipts and all information listed above must be turned in with your personal receipts. Please sign the cover sheet indicating that you have provided the Election Committee with a complete and accurate accounting of all funds expended on your behalf.

You may not solicit campaign contributions from any other union, any employer, CUE Statewide, other CUE Locals. Union funds may not be used to support any nominee.

Review of Membership List

You are entitled to view the member mailing list one time during the period prior to the mailing of ballots to the members. You do not have the right to a copy of the list, or a list of the members mailing addresses. Please notify the Election Committee immediately if you would like to see the mailing list. We will have to work out a process to ensure access prior to the mailing of ballots.

Attending Ballot Count

The ballot count will occur on October 14, 2006 in Berkeley at the Statewide Office. You are entitled to attend the ballot count or to send an observer at your own expense. The Statewide organization will only pay for the Election Committee to travel to Berkeley to do the official count. The Election Calendar has been updated for the final time and the count will occur as posted unless there is a problem for the printers and/or mailing house. The Election Committee will notify you of any changes as soon as we are notified that there has been a delay in the process.
