Mediated: Wages (alternative #1)

  1. GENERAL RANGE ADJUSTMENTS AND INDIVIDUAL INCREASES EXCEPT LBNL:

    1. Fiscal Year 2001-2002

      1. Following written notification from CUE of its ratification and acceptance of this entire Agreement with the University of California, the University will, effective the first pay date after the effective date of this Agreement, increase the salary ranges, including steps for the classifications in the Clerical and Allied Services Unit (Unit 12) by 1% as indicated in Appendix A. Eligible employees in this unit will receive a 1% base-building salary increase based on a 1% within range step adjustment effective November 1, 2001, or the first bi-weekly or semi-monthly pay period after November 1, 2001. Eligible employees shall be those members of the bargaining unit who are on the payroll in the bargaining unit, or on approved leave, as of the effective date of this Agreement. Employees at the maximum salary for their classification will receive an adjustment to the extent that the new range exceeds their present rate. The parties recognize that the actual salary range or rate adjustment for each class and individual will vary slightly due to rounding (Appendix _).
      2. The University will process the prospective individual salary increases as soon as practicable, but in no event more than 90 calendar days following the first pay date following the effective date of this Agreement.

        a. The parties recognize that there will be no merit program for 2001-02.

    2. Fiscal Year 2002-2003

      1. Following written notification from CUE of its ratification and acceptance of this entire Agreement with the University of California, the University will, effective the first pay date after the effective date of this Agreement, increase the salary ranges, including steps for the classifications in the Clerical and Allied Services Unit (Unit 12) by 1.5% as indicated in Appendix _. Eligible employees in this unit will receive a 1.5% base-building salary increase based on a 1.5% within range step adjustment effective October 1, 2002, or the first bi-weekly or semi-monthly pay period after October 1, 2002. Eligible employees shall be those members of the bargaining unit who are on the payroll in the bargaining unit as of the effective date of this Agreement. Employees at the maximum salary for their classification will receive an adjustment to the extent that the new range exceeds their present rate. The parties recognize that the actual salary range or rate adjustment for each class and individual will vary slightly due to rounding (Appendix _).
      2. The University will process the prospective individual salary increases as soon as practicable, but in no event more than 90 calendar days following the first pay date following the effective date of this Agreement.

        c. The parties recognize that there will be no merit program for 2002-03.

    3. Fiscal Year 2003-2004

      The University and CUE shall negotiate over Article 43, Wages, in accordance with the provisions of Article ____, Duration.

    4. A. INDIVIDUAL SALARY INCREASE EXCEPT AT THE LAWRENCE BERKELEY NATIONAL LABORATORY.

    5. The University will not implement the merit program for 2001-02 or 2002-03. Each eligible step-based employee will receive a within-range 1% range adjustment The University and CUE agree that the merit program is a desirable part of the University’s total compensation program and the parties agree to discuss it in future negotiations.

      The University will not implement the merit program for 2002-03. Each eligible step-based employee will receive a within-range 1.5% range adjustment.

      Employees who are at or near the minimum of the new range for their classification shall receive an adjustment equivalent to the respective range adjustment or to the extent the new minimum exceeds their current rate, whichever is greater.

    6. Employees who retired prior to the effective date of this agreement shall be eligible for applicable increases provided this does not violate UCRS regulations.
  2. ORDER OF INCREASES

    If more than one salary adjustment takes place on the same date, actions will occur in the following order:

    1. Range Adjustments;
    2. Increases resulting from Promotion or Reclassification
  3. OTHER INCREASES

    1. The University may increase, during the term of this Agreement, individual salary rates, or salary ranges for selected classes at selected locations. The University may also increase, for selected classes at selected locations, during the term of this Agreement, shift differentials, on-call rates, and/or extend the coverage of such rates. At least thirty (30) days prior to implementing the increase referenced in this section, the University shall inform CUE.
  4. INCREASES FOR ALL CLERICAL AND ALLIED SERVICES UNIT EMPLOYEES (UNIT 12) AT THE LAWRENCE BERKELEY NATIONAL LABORATORY.

    1. The Side Letter of _________________, 2001 shall be incorporated into this Agreement and attached as Appendix ___, and Wages for 2003 will be included in the reopener negotiations according to Article Duration.
    2. All other provisions of this Wage Agreement will not apply to LBNL, except Section F., below.
  5. The range and rate adjustments, base or non-base, if any, provided in this Article shall not be subject to Article __ Grievance Procedure, or Article __ Arbitration Procedure, of this Agreement.
