JANEENE FISHER HARDSHIP GRANT POLICY

I. Purpose

The Coalition of University Employees, Davis Local 7 ("Local 7") is a labor organization dedicated to providing mutual aid and support for members of the organization; to encouraging cooperation and solidarity among all clerical unit employees of the University of California, Davis ("University"); and to advocating and fighting for improvements in the wages, hours, and terms and conditions of employment for all members.

The Executive Board of Local 7 views its mission and purpose broadly: although Local 7 primarily represents its members in interactions with the University, the Executive Board desires to assist and offer support to its members who, as a result of catastrophic circumstances or significant hardship, suffer a loss of income.

The Executive Board has, in the past, provided financial assistance to members who have suffered a loss of income while off work on medical leave. The Executive Board adopts this hardship grant policy in order to establish guidelines for future grants to Local 7 members.

II. Eligibility

The Executive Board will consider grants of financial assistance to members who are absent from work and suffer a loss in income as a result of their own or a family member's illness or a natural disaster. No grant will be given to members who are not in good standing with the Union.

III. Grants

The Executive Board will consider requests for assistance from members who have exhausted their vacation, sick leave, compensatory time off and catastrophic leave provided under Local 7's collective-bargaining agreement with the University but suffer a loss of income due to a catastrophic illness (either the member's own, or a family member's, illness) or natural disaster (including loss of use of a member's home). The amount of the grant provided is determined on a case-by-case basis, measured by the member's documented financial need and the Union's available resources at the time of the application.

In considering a request for financial assistance, the Executive Board will look at whether the member has first exhausted all other sources of assistance and/or income replacement available from the University, private insurance or governmental agencies. Grants may be given, for example, to help members bridge the gap between the exhaustion of paid leave and the commencement of short- or long-term disability payments.

IV. Application

The Executive Board will consider requests for assistance from a member, either on his or her own behalf, or, in appropriate circumstances, by a member on behalf of another member. Requests should include, to the extent possible:

  1. The reason the member has lost time from work;
  2. An explanation of other sources of income;
  3. The amount of financial assistance requested; and
  4. An explanation of any other extenuating circumstances.

The Executive Board will review all requests in closed session and shall endeavor to keep all information confidential. If financial assistance is requested by or on behalf of a member of the Executive Board, that member shall recuse himself or herself from all discussions related to the request.

V. Amount of Grant

The Executive Board has the sole and absolute discretion to determine the amount of the grant, but shall ordinarily award no more than $2,500 total to any member in his or her lifetime. The Board may in its discretion award a lesser amount, decide whether payment should be made by lump sum or in installments or determine that no grant shall be paid.

Should the Executive Board determine that the Union's general assets are insufficient to both meet the Union's operating expenses and offer financial assistance, it may decline a request for a benefit without reference to the merits of the request.

VI. Repayment

Each member who receives financial assistance will be asked to repay the grant if he or she receives assistance in an equal or greater amount from another source. The Executive Board may, in its sole discretion, relieve a member of having to repay his or her grant under appropriate circumstances.

VII. No Rights Created by this Policy

This policy shall not give any member a right or entitlement to financial assistance. All grants shall be made at the sole and absolute discretion of the Executive Board.

VIII. Taxes

The member shall be responsible for all federal and state taxes due on any grant received, if any is due.

VIII. Local Constitution

This policy shall not be construed so as to relieve the Executive Board from its obligations under the Local Constitution.
