Article 36: Workplace Privacy
A. Any counseling and discipline of staff shall be conducted in a confidential setting.
B. Except as required by law, no personal information shall be disclosed by CUE without express written consent of the worker, except that LWU shall have the right to obtain personnel files or other information necessary and relevant for fulfilling its representational obligations.
C. Workers shall have a reasonable expectation of privacy with regard to their personal possessions while in the workplace. In the event an investigation into serious misconduct or other emergency situations makes it necessary to search a worker's workstation or belongings, such action shall be taken only by the worker's designated supervisor(s). If the supervisor taking such action would pose a conflict of interest, CUE shall select an alternate individual who presents no conflict of interest to perform the search.
D. Except as required by law, no member of the bargaining unit shall be subjected to drug, alcohol, polygraph or medical testing, electronic surveillance, fingerprinting and/or background checks.
