Demand to Bargain Form Letter

If your department tries to implement new work rules or other changes to the terms and conditions of your employment during this status quo period, have one of your local CUE representatives write a demand to bargain letter. A sample is provided below. Feel free to personalize the letter by filling in specifics where there is currently place-holder language in parentheses.

Dear (fill in the name of your local LR head):

In light of the expiration of the parties' contract, CUE demands to bargain at the table both the decision and the effects of (fill in proposed changes). CUE expects that (this proposed change) will be bargained with our designated bargaining representatives in systemwide negotiations.

In order to prepare and adequately represent the affected employee(s), the union requests information on your intent to (fill in proposed changes). We are also requesting that no action take place regarding this proposed change, given that we are in the status quo period relative to the CX unit. We demand to bargain with you on this policy, and its effects on the clerical employees in this Department. Please note that failure to bargain constitutes an unfair labor practice, and that charges will be filed if you implement these changes prior to bargaining with CUE.

Please consider this an official request for information, which is both necessary and relevant for the purpose of bargaining this proposed change:

Please send the information to us as soon as it becomes available at 2855 Telegraph Ave, Suite #302, Berkeley CA 94705, but in no case later than (15 calendar days from the date of this request). This request is made without prejudice to the union's right to file subsequent information requests. Please provide the information as it becomes available. If any part of this request is denied, or if the information is unavailable, please provide the remaining items by (the above date), which the union will accept without prejudice to its position that it is entitled to all documents and information called for in this request.
