Sample letter for casual employees

If you are a casual employee you may be eligible for UC retirement benefits if you fit the following eligibility guidelines:

1) you have had extended or successive appointments in the same job, which together exceed one year of service at 50% time or more, and
2) in your position you have and/or had a reasonable expectation of extension or renewal of your appointment as a casual.

CUE believes that UC may have improperly ignored the retirement benefit rights of many UC casual employees. We encourage you to participate in CUE's efforts to obtain retirement benefits for casual employees who are entitled to these benefits by filling out and returning the letter below.

The purpose of this letter is to put UC and the University of California Retirement System (UCRS) on notice of your possible eligibility and entitlement to retirement benefits. If you believe you fit the definition for retirement plan eligibility quoted in the second paragraph of the letter, we encourage you to take this chance to benefit yourself and your family by requesting a determination of your entitlement to past and future UC retirement benefits.

You have the right to make this inquiry without fear or threat of adverse action. In order to protect your rights to fight for retirement benefits that you may have been or might be wrongfully denied, please let us know about any contacts you have/had with UC or UCRS regarding your request.

Please fill out and sign the letter to Judy Boyette, UC's Vice President of Human Resources and Benefits, and return to CUE at P.O. Box 618, Berkeley, CA 94701. We will deliver your letter with many others to the University and UCRS.

RE: eligibility for UCRP benefits

Dear Associate Vice President Boyette:

I have been employed at UC (fill in your campus) for (fill in the number of years) years as a casual employee. My job title/classification is (fill in your job title). This appointment has or had every prospect of renewal or extension. It is my belief under UCRP Plan Regulations that I should be immediately offered full UC retirement and benefit rights.

The UCRS plan has the following language which reinforces the legitimacy of my claim above:

"The persons eligible to participate under UCRP are all employees of the University who are appointed to work 50% time or more on a fixed or variable percent of time basis for an indefinite period, for a definite period of one year or longer, for a shorter definite period with the reasonable prospect of renewal or extension of such appointment, as determined in accordance with Plan Regulations."

I, therefore, request immediate retroactive enrollment in the UCRS with full benefits.
