Joint CUE and UPTE Bargaining for Casual Employees -- Update for Clerical, Research and Health Care Professional, and Technical Employees
Dear Clerical,

If you are a casual employee, this message contains important information about protecting your rights. If you have co-workers or friends who are "casuals" please pass this on to them.

CUE and UPTE have been bargaining together to try to improve conditions for thousands of casual employees around the state. After several meetings with UC, CUE/UPTE and UC have reached agreement on the following solution.

CUE and UPTE have pushed the University to convert the status of thousands of employees in the UC system from casual to career, with specific guidelines.


Definition of Eligible Employees

Casual employees who have worked 1000 hours within any 12-month period between Jan. 1, 1998 and Jan. 1, 2001, and did not have a break in service of 120 days or more.
If you are eligible, you will automatically become career, effective immediately. (In some cases, you may be required to inform HR that you are eligible. Stay tuned for more information on this requirement.) If you are eligible AND you worked as a casual employee in the same or similar job and get converted to career, you are eligible to have your probation reduced from six months to one week. From now on, the term "casual" will be changed to "limited appointment" and UC agrees that these will actually be short-term employees, in contrast to the current situation where some "casual" employees work for many years.

Temporary Pools to be Eligible for Conversion to Career Status

For those campuses that have temporary employment pools, UPTE- and CUE-represented employees in those pools will automatically convert to career status after working 18 months, no matter how many hours they work each of those months.

The University has defined the limited uses of the temporary pool and has committed to not abuse these limits for this job category. These provisions do not apply to temporary employees hired by UC from outside private agencies. In order to monitor UC's actions, UPTE and CUE will receive weekly reports of employees moved into and out of the temporary employment pool. As always, the unions have the option to renegotiate if this is not working well.

Retirees Can Opt Out of Paying into UCRS

Retirees who have come back to work can elect to not pay into the retirement fund. This will enable them to continue to receive their monthly retirement payments.

Retroactive service credit -- how you can fight for it

Filing a claim for retirement service credit

You are eligible to file a claim for retirement service credit if:

a. you worked 1000 hours in a 13-month period and will be converted to career status

OR

b. if you were a casual employee who was reappointed -- with a short break in service -- to the same position you had been working in, and the total period of employment exceeded 12 months.

To file a claim for retirement service credit, print this sample letter and mail it to Judy Boyette. Make sure to send a copy of the letter to CUE, 2855 Telegraph Road, Suite #302, Berkeley, CA 94705.
