Incentive Award Program (IAP) Agreement for 2004-2005

This agreement on distribution of IAP awards was reached between CUE and UC on February 23, 2005. Here is the original signed agreement as a PDF file.

The University and CUE enter into the following agreement with respect to the distribution of 04-05 incentive award/bonus/training and development programs and related issues according to 1-4 below.

  1. The University and CUE agree that, at all locations, clerical employees shall be eligible in the 04-05 fiscal year programs for incentive awards/bonuses/training/development programs according to local procedures. n any locations where such programs have already commenced and/or concluded without clericals being eligible, clerical employees shall be eligible to participate in such programs in a reasonable amount of time.
  2. CUE withdraws its proposal that the University provide increases to base salaries for fiscal year 04-05 from those monies allocated to conduct those programs referenced in paragraph 1 or those programs that have already been concluded.
  3. The University and CUE agree that this side letter does not pertain to, or in any way, affect the separate agreement between Berkeley campus and CUE regarding Berkeley's CDOP Program for 04-05.
  4. This agreement is incorporated as a side letter to the parties current MOU and any dispute regarding the implementation of this agreement shall be covered by the terms of the expired MOU. Alleged violations of this side letter may be addressed through contractual enforcement mechanisms that continue under the status quo or through the regular PERB procedures.
