Bargaining Update re: 2 Bonus Leave Days

Bargaining sessions held in Santa Barbara on December 1st and 2nd with university negotiators ended without an agreement concerning the 2 Bonus Leave Days.

The university negotiators rejected the counterproposal offered by the CUE bargaining team.

You should know that CUE has filed an unfair practice charge with PERB regarding the curtailment shutdown. One of the remedies which CUE will seek is reimbursement of vacation time, comp time, and wages for those using leave without pay during the curtailment period.

University chief negotiator Peter Chester recently contacted CUE's negotiator to schedule an additional session on Tuesday, December 21 in Oakland. CUE bargaining team members will attend the session but it is doubtful that a resolution will be reached. It appears that the university has requested this meeting merely as a legal formality in hopes of establishing a defense against the union's unfair practice charge.

CUE will notify you if there is any change in the negotiations, however, your available options regarding the curtailment period are:

Please note that this would be authorized leave without pay therefore you will be paid for the specified holidays.

If you are advised by your supervisors or payroll representative that leave without pay the day before or after the holiday will result in your not receiving the holiday pay, this is inaccurate information. This issue was discussed during the Santa Barbara bargaining sessions and the university representatives confirmed that anyone using leave without pay-despite its proximity to a paid holiday--would be paid for the holiday because the leave without pay is "authorized." Please notify CUE if there is any dispute regarding this with your department payroll representative.
