Negotiations Should Continue
During the October 24-26 bargaining session in San Diego, CUE gave UC
three new proposals - Hours of Work, Performance Evaluations, and
Parking/Transit. UC did not give CUE any new language.
CUE persuaded UC that bargaining should go forward whether or not the
contract is extended beyond October 31, 2001. A bargaining session has
been scheduled for November 6-9, 2001 in Oakland and another in Riverside
for November 28-29, 2001.
Overtime - Paid Out or Accrued Comp?
We discussed extensively differences on overtime pay versus compensatory
time. UC is telling supervisors that if employees do not file a request
indicating a preference for compensatory time or payment, the department
can continue to do as they have in the past. This is not CUE's
interpretation of the current contract language. The language clearly
states that overtime shall be paid in cash unless the employee and UC
agree otherwise. Clericals and the union need to file grievances in order
to enforce the contract. If you were told you may not be paid out for

Wages/Health & Safety/Subcontracting
CUE and UC continued to discuss Wages and Health & Safety, but we are
still very far apart on those issues. We also had extensive discussions
about subcontracting. CUE is waiting for a counter from UC on this
article.
UC refused to budge on their wages offer of 1% and no merits. CUE again
urged UC's chief negotiator to go back to the administration and let them
know how clericals feel about this insulting offer.
Catastrophic Leave
We discussed Catastrophic Leave. UC has offered to extend equal treatment
to clericals at UCSD when the contract is ratified. This will finally
allow clericals at UCSD to give and receive leave donations like other UC
employees, to all UCSD employees, not just other clericals. CUE urges
this change sooner rather than later.
Miscellaneous
The article on Payroll Deduction was tentatively agreed to and discussion
concerning the Agreement article brought the two sides very close to
agreement. UC offered a new proposal on job reclassifications that take
employees out of the clerical bargaining unit. This proposal appears to
meet the concerns we expressed earlier and we hope to finish this
discussion next week.
PS At the last bargaining session in Santa Barbara (October 9-11), Irvine
bargainer Elaine Hernandez was not present and alternate Cynthia Norman
attended bargaining in her place. Apologies for this omission in the last
update.
